Terms of Service
Please read these terms carefully before using the COMX ERP platform. By accessing or using our services, you agree to be bound by these terms and conditions.

Acceptance of Terms
By accessing, browsing, or using the COMX ERP platform (hereinafter referred to as “the Service”), operated by COMX ERP (“we,” “us,” or “our”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”).
If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. If you do not have such authority, or if you do not agree with these Terms, you must not accept these Terms and may not use the Service.
Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes. We recommend reviewing these Terms periodically.
Description of Service
COMX ERP is a cloud-based Enterprise Resource Planning (ERP) platform designed for Pakistani businesses. The Service provides an integrated suite of business management modules, including but not limited to:
- Point of Sale (POS) — Billing, barcode scanning, receipt printing, and multi-terminal support.
- Inventory Management — Real-time stock tracking, automated reorder points, batch management, and multi-warehouse operations.
- Customer Management (CRM) — Customer profiles, purchase history, loyalty programs, and targeted communications.
- Accounting & Finance — Automated bookkeeping, tax compliance, financial reporting, and bank reconciliation.
- Human Resources & Payroll — Employee management, attendance tracking, payroll processing, and leave management.
- Analytics & Reporting — Real-time dashboards, custom reports, sales trends, and business intelligence.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, module, database, or content. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.
Account Registration & Security
To access and use the Service, you must register for an account. When registering, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information to keep it accurate, current, and complete.
- Maintain the security and confidentiality of your login credentials, including your password.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account or any other breach of security.
You are responsible for all actions taken under your account, whether or not authorized by you. We shall not be liable for any loss or damage arising from your failure to comply with these security obligations.
We reserve the right to suspend or terminate accounts that we reasonably believe contain inaccurate information, have been compromised, or are being used in violation of these Terms.
Subscription & Payment
COMX ERP offers subscription-based access to the Service. All prices are quoted in Pakistani Rupees (PKR) unless stated otherwise. By subscribing to a paid plan, you agree to the following:
- Billing Cycles — Subscriptions are available on monthly and annual billing cycles. Annual plans are billed upfront for the entire year at a discounted rate.
- Payment Methods — We accept bank transfers, JazzCash, EasyPaisa, and credit/debit cards. Annual plans may also be paid via cheque.
- Automatic Renewal — Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will be charged the then-current subscription rate at the time of renewal.
- Price Changes — We reserve the right to modify pricing at any time. Price changes will take effect at the start of the next billing cycle following notice to you. Continued use of the Service after a price change constitutes acceptance of the new pricing.
- Taxes — All prices are exclusive of applicable taxes. You are responsible for paying any taxes levied by governmental authorities, including sales tax and withholding tax, as applicable under Pakistani law.
- Refunds — Monthly subscriptions are non-refundable. For annual plans, a pro-rated refund may be issued within the first 30 days of the subscription, less any applicable processing fees.
Failure to pay outstanding fees may result in suspension or termination of your access to the Service. We may engage third-party collection agencies to recover unpaid balances.
Data Ownership
You retain full ownership of all data, content, and information that you submit, upload, or transmit through the Service (“Your Data”). COMX ERP does not claim any ownership rights over Your Data.
By using the Service, you grant us a limited, non-exclusive license to access, process, and store Your Data solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete Your Data or close your account.
You may export Your Data at any time using the built-in export tools provided within the platform. Upon termination of your account, we will make Your Data available for export for a period of 30 days, after which it will be permanently deleted from our systems in accordance with our data retention policies.
We maintain regular backups of Your Data as part of our infrastructure operations. However, you are encouraged to maintain your own independent backups of critical business data.
Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service in any way that violates any applicable federal, provincial, or local law or regulation in Pakistan or any other jurisdiction.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, servers, or networks connected to the Service.
- Use any automated system, including robots, spiders, or scrapers, to access the Service for any purpose without our express written permission.
- Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
- Sublicense, resell, rent, lease, transfer, or distribute access to the Service to any third party without our prior written consent.
- Use the Service to store or transmit any content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable.
Violation of this acceptable use policy may result in immediate suspension or termination of your account, at our sole discretion, without prior notice or refund.
Service Availability & SLA
We strive to maintain high availability of the Service and target an uptime of 99.9% measured on a monthly basis, excluding scheduled maintenance windows.
Scheduled maintenance will be performed during off-peak hours (typically between 2:00 AM and 6:00 AM PKT) and will be communicated in advance via email or in-platform notifications. Emergency maintenance may be performed at any time without prior notice if necessary to protect the integrity or security of the Service.
In the event that the Service fails to meet the 99.9% uptime target in a given month, Enterprise plan subscribers may be eligible for service credits as outlined in their individual Service Level Agreement. Service credits are the sole and exclusive remedy for any failure to meet the uptime commitment.
The uptime commitment does not apply to: (a) features labeled as beta or preview; (b) outages caused by factors outside our reasonable control, including force majeure events; (c) interruptions resulting from your actions or equipment; or (d) outages caused by third-party service providers.
Intellectual Property
The Service and its original content, features, functionality, design, source code, and all associated intellectual property rights are and shall remain the exclusive property of COMX ERP and its licensors. The Service is protected by copyright, trademark, and other laws of Pakistan and foreign jurisdictions.
The COMX ERP name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of COMX ERP. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly in accordance with these Terms. This license does not include the right to: (a) modify or make derivative works based on the Service; (b) use data mining, robots, or similar data gathering methods; or (c) download or copy account information for the benefit of a third party.
Limitation of Liability
To the maximum extent permitted by applicable law, COMX ERP, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Service.
- Any conduct or content of any third party on the Service.
- Any content obtained from the Service.
- Unauthorized access, use, or alteration of your transmissions or content.
In no event shall COMX ERP's aggregate liability for all claims relating to the Service exceed the total amount paid by you to COMX ERP during the twelve (12) months preceding the event giving rise to such liability.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. To the extent that these exclusions or limitations are not permitted, COMX ERP's liability shall be limited to the fullest extent permitted by applicable law.
Termination
You may terminate your account at any time by contacting our support team or using the account closure feature within the platform. Upon termination:
- Your right to access and use the Service will cease immediately.
- You will remain responsible for all fees incurred prior to termination.
- Your Data will be available for export for 30 days following termination, after which it will be permanently deleted.
- Any unused portion of a prepaid subscription is non-refundable, except as specified in Section 04.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Grounds for termination include, without limitation:
- Violation of these Terms or our Acceptable Use Policy.
- Non-payment of subscription fees.
- Requests by law enforcement or government agencies.
- Discontinuation or material modification of the Service.
- Extended periods of inactivity.
Provisions of these Terms that by their nature should survive termination shall survive, including without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Islamabad, Pakistan.
Before initiating any legal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation for a period of not less than thirty (30) days. If the dispute cannot be resolved through negotiation, either party may pursue formal legal remedies.
Changes to Terms
We reserve the right to modify or replace these Terms at any time, at our sole discretion. When we make material changes, we will provide reasonable notice, which may include:
- Posting a prominent notice on the platform dashboard.
- Sending an email notification to the address associated with your account.
- Updating the “Last updated” date at the top of these Terms.
Your continued use of the Service after any changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and terminate your account.
It is your responsibility to review these Terms periodically for updates. Changes to these Terms are effective when posted on this page.
